Mesothelioma Lawsuit after Mothers Death

Asbestos Lawyers representing a Texas family have filed a mesothelioma wrongful death lawsuit alleging that their mothers death was caused by her exposure to asbestos after years of washing clothes for the family. Lawyers in other states have successfully fought similar cases where people contracted the deadly disease from doing asbestos-laden laundry.

The family of Claudia Headley filed the lawsuit last week against Shell Energy North America (US) LP, Royal Dutch Shell PLC, Exxon Mobile Corp. and Alon USA, as successor in interest to Cosden Petroleum.

The case alleges she contracted mesothelioma after years of washing clothes for her father, then husband, then son, which were coated with asbestos dust from the mens jobs in oil refineries. Headley passed away from the disease on May 30, 2008.

The lawsuit alleges Mrs. Headleys father worked at the Big Spring Refinery for 38 years, which has since been purchased by Alon. Her husband and son worked at refineries operated by Shell or Exxon.

The suits claims that the companies did not fulfill their duty to provide a safe workplace, to warn of work health hazards, or to protect the safety of others when an employee performs work that is inherently dangerous and to avoid a foreseeable risk of injury to others.
